Today's Daily Post reports that Save Menlo is listing individuals as supporters who are not actually supporter - including a former Mayor.
And now a number of people have reported that the signed the initiative petition but did not agree to be a supporter.
Here is the law on such use of initiative signatures:
"Elections Code Section 18650.
No one shall knowingly or willfully permit the list of signatures on an initiative, referendum, or recall petition to be used for any purpose other than qualification of the initiative or referendum measure or recall question for the ballot, except as provided in Section 6253.5 of the Government Code. Violation of this section is a misdemeanor."
Save Menlo has failed to comply with disclosure requirements on its signs and, until over a month after I challenged them on this, on their web site pages. Now they are illegally using people's names as supporters. Is there no end to what they will do?
Are these the people that we want writing new laws? "
1. Carpenter complained about SaveMenlo signs to the FPPC, and they told him to go away.
2. The code section, Carpenter cites here is not relevant to the case at hand.
The issue here is Chuck Kinney, an ex-mayor, who apparently has changed his mind about supporting Measure M. Chuck signed a letter of support earlier this year; I was there when he signed.
SaveMenlo in no way violated the code section Carpenter cites here; Kinney's signature of support for Measure M, was not from the initiative; it was from a completely separate endorsement letter.
Kinney, certainly has the right to change his mind. However, in writing, he did support Measure M previously.
Kinney is quoted (in the POST) as saying he got unwelcome calls asking why he supported Measure M. Kinney says "I just want it to die,"
Kinney was a PAID consultant to David Bohannon in 2010 and worked to support Bohannon's Gateway project. One should wonder how many of those calls were from David Bohannon?
