More miss-information from Peter Carpenter

Peter Carpenter, the Atherton resident, has posted the following in another (open only to registered users) thread.

Today's Daily Post reports that Save Menlo is listing individuals as supporters who are not actually supporter - including a former Mayor.

And now a number of people have reported that the signed the initiative petition but did not agree to be a supporter.

Here is the law on such use of initiative signatures:

"Elections Code Section 18650.

No one shall knowingly or willfully permit the list of signatures on an initiative, referendum, or recall petition to be used for any purpose other than qualification of the initiative or referendum measure or recall question for the ballot, except as provided in Section 6253.5 of the Government Code. Violation of this section is a misdemeanor."

Save Menlo has failed to comply with disclosure requirements on its signs and, until over a month after I challenged them on this, on their web site pages. Now they are illegally using people's names as supporters. Is there no end to what they will do?

Are these the people that we want writing new laws? "

1. Carpenter complained about SaveMenlo signs to the FPPC, and they told him to go away.

2. The code section, Carpenter cites here is not relevant to the case at hand.

The issue here is Chuck Kinney, an ex-mayor, who apparently has changed his mind about supporting Measure M. Chuck signed a letter of support earlier this year; I was there when he signed.

SaveMenlo in no way violated the code section Carpenter cites here; Kinney's signature of support for Measure M, was not from the initiative; it was from a completely separate endorsement letter.

Kinney, certainly has the right to change his mind. However, in writing, he did support Measure M previously.

Kinney is quoted (in the POST) as saying he got unwelcome calls asking why he supported Measure M. Kinney says "I just want it to die,"

Kinney was a PAID consultant to David Bohannon in 2010 and worked to support Bohannon's Gateway project. One should wonder how many of those calls were from David Bohannon?

Yes it is as it may apply to Ann Moser, Sally Porter or others who have complained but not yet allowed the misuse of their names to be published. The poster makes no mention of Sally Porter, who was one such illegally listed supporter. When Ms. Porter called Heyward to tell him of the error, Heyward's response was asking her to "let it go".

The letter old timer is referring to was to the Almanac on April 9, 2014 well before the submission of signatures to the City to qualify the Initiative. The letter was solely focused on having people sign the Initiative so it could go on the ballot. To my knowledge Chuck never endorsed Measure M.

Please keep looking for documented facts to refute my statements.

"Old timer" Would it be possible for you to make your case without attacking Mr. Carpenter or Mr. Kinney personally?

And we all know Mr. Carpenter lives in Atherton. As if common-sense (and traffic) starts/stops at MP's boundaries? We are all part of this larger community and will all be impacted by the outcome of this election, whether or not we can actually vote.

Oh my word... how dense can any one person be.

Here Peter Carpenter, the Atherton resident, says Kinney did not endorse Measure M. Well he certainly signed a letter with 8 other ex-mayors urging in no uncertain terms, that the initiative be signed

Is this not endorsing the Initiative? How dense can you be?

Now Peter for this code section to apply to Porter or Moser, they would have had to sign the initiative. Do you have information that they did indeed sign? If not I say to you "buzz off", just like the FPPC has told you. GO AWAY.

No, Kinney was making a statesman-like appeal to people to sign a petition to put this issue on the ballot.

Many of the signature gathers made the pitch "This is just to put the issue on the ballot" and then their names were illegally listed as supporters.

I have verified this with a number of such individuals whose names were illegally used.
