Colin Troy Smith, 43, of San Carlos, faces more than nine years in prison but the Probation Department is recommending probation, District Attorney Steve Wagstaffe said.

Let me get this straight: DA Wagstaffe NEVER told the press about the two incidents of felony violent assault by Deputy Colin Troy Smith. The Palo Alto Daily Post was the paper who stumbled upon it with their own intrepid reporting. When asked why he hadn't included the assault on his list, Wagstaffe said he never got the email from the prosecutor on the case... Right...

And yet Juan Lopez is arrested for smuggling a cell phone to an inmate and Wagstaffe HOLDS A PRESS CONFERENCE ABOUT THIS?

When are the San Mateo County reporters going to investigate the discrimination and bias here in how the DA's office disseminates its cases to the press? This is a matter of civil rights.

When you break the law while wearing a badge, you deserve to have the entire book thrown at you (along with the combined works of Tolstoy, etc..) We give the ultimate power to an individual when we give him the badge and gun - betray the trust - go directly to jail.

Do not pass Go....

Same thing with conspiracy to provide gang members a phone in jail, if convicted.

Do not collect two hundred dollars...

I agree with Mr. Wagstaffe on this one 100%

Steve Wagstaffe " We just feel there is nothing that warrants the consideration of probation."

This would be a perfect case for a Citizens Oversight Committee to look at the Probation Officer and what lead to this recommendation.

The Good News is the San Mateo County Probation Chief John T. Keene has acknowledged that he knows nothing about this case or the recommendation for Zero days vs. 10 years in prison, in the Colin T. Smith case.

Thank You goes to Mark DePaula for asking him for a meeting with some citizens to discuss how did this happen.

Amazing isn't it? For the badge wearing uniformed officers whom go unscathed and without wounds but to the normal citizens the book is throw; the D.A. finds even more allegations out of someexaggerated police report that is remotely at best true...

Colin T. Smith is still out his next court date is.
May 29, 2015 8:30 before Judge Davis, to set a date for imposition of sentence.

Hon. Judge Leland Davis lll

Has just granted Colin T. Smith a new trial. I'm not sure of the details at this time.

What I am sure of is the judge said Zandra Ekholm lied on the witness stand, and "I can not say that Mr. Smith got a fair trial."

Since Judge Leland Davis lll knows she lied on the witness did he ever report it as a crime to be prosecuted?

So the DA's office decided yesterday not to retry Deputy Sheriff Troy Smith for violent felony assault. This is the case that was originally never put in police reports and was never included in the DA's daily press list. If it weren't for the Palo Alto Daily Post, we would never have known about the case. Why?

Troy Smith, who beat up the boyfriend of his ex-girlfriend so horrifically that his victim had to have eye socket surgery, walks away, scot-free.

But Juan Lopez, who allegedly took a photo of an inmate at the jail with a cell phone, is still going to trial.

The DA decides to not retry a (I assume FORMER) deputy sheriff for felony assault and/or battery. If true, isn't that newsworthy? What is the explanation?

The Troy Smith story was on the front page of the Palo Alto Daily Post yesterday. But so much of it made no sense. The story implies that the DA is NOT retrying the case because Troy's former girlfriend was also beaten by Smith? Wouldn't that be more damning evidence against Smith?

Almanac: can someone please investigate further? Given that the DA never alerted the press when the crime happened and strangely, there were no police reports on the two violent Smith incidents- this raises more questions. It strikes me as bizarre and unfair that the Smith case was shrouded in secrecy- just like the case where the San Mateo cop who was raping women which only came to light through an SF TV station- and yet Wagstaffe and Munks hold a press conference to announce they were charging Juan Lopez for a cell phone. It all stinks.

The PA Daily Post story says the DA isn't retrying the case because the two victims didn't want to testify again. Really? Has anyone thought to contact the victims directly? Please fact check!

Which reminds me.. whatever happened to Menlo Park police Jeffrey Kenneth Vasquez, who was caught with the SF Redbook prostitute but still got to keep his job?Is he still around ? How about a followup? How come all of the Oakland police officers were forced to resign last week after being with a prostitute but Vasquez gets to keep his job? There's so much corruption in San Mateo, and yet reporters seem to shy away from it.
