High Speed Rail: Court orders EIR de-certified for a 2nd time.

In a decision released today, Judge Kenny ordered the High Speed Rail Authority to de-certify the program level EIR for the Bay area to Merced.

The main thrust of the decision was the EIR was defective on the traffic impacts to the Monterey Highway that would be caused by the HSR rail line.

The suit brought by Atherton / Menlo Park et. al. deals another setback for the Authority. This is the second time this EIR has been ruled defective and must go back, and address its defects, be re-circulated etc.
