Below is the text of an e-mail exchange between Atherton Police Chief Michael Guerra and me, in regards to the Chief's handling of my personnel complaint.

Dear Mr. Guerra
I have yet to receive a reply to the questions raised in my note to you below.
It is for the above reason that I will take you up on your offer to meet with me as is provided for in Atherton's disciplinary policies and procedures.
In advance of that meeting, I would ask that you please be prepared to respond to the questions posed to you in the e-mail below and in regards to the questions and concerns listed below:
The nature of your contractual relationship with Mr. Peterson including the extent to which you or Lieutenant Wade exercised influence over the parameters of the investigation, including but not limited to the number of hours to be expended on the investigation and the cost thereof, the timing of the release of the report, and the identities of whom would be investigated or interviewed during the Peterson investigation
Whether or not you have initiated or have asked another law enforcement agency to initiate an investigation into my accusation of evidence tampering, falsification of police reports 07-474 and 07-484, false arrest and a violation of my civil rights under color of authority
Whether Mr. Peterson made any effort to interview Mr. Brian Kelly, Mr. Jerry Carlson and Mr. Clark Yee as I had requested him to do
Whether you received any acknowledgement from either the San Mateo County DA or the FBI as to whether a criminal investigation against former Chief Robert Brennan, former Sergeant Eric Grimm, Detective Sherman Hall, Sergeant Tim Lynch, Officer Tim Marks, Officer Kristin Nichols, Officer Brad Mills has been initiated pursuant to complaints I made subsequent to March 2010
Whether Lieutenant Joe Wade was ever investigated for a possible violation of Government Code Section 8314 as a result of his having received exercise equipment (apparently for personal use) which was purchased for his benefit on a Town issued credit card
Whether you yourself have ever been investigated for using Town time and property for performing management consulting services as you advertise is the case in the following links:

Whether in view of the possible instances of fraud as mentioned in the two bullet points above you and Lieutenant Wade were or are capable of performing objective investigation as to whether the Police Department's criminal investigation of me on similar allegations was justified and was conducted properly
By copy of this e-mail to Mr. Danielson and to each member of the City Council, I ask that the objective of the administrative investigation into your handling and that of Mr. Wade of my citizen's complaint include an examination into whether, as I allege herein, you and Mr. Wade have benefited from the improper use of Town property for personal and professional reasons.
It is my sincere belief that your handling of the Peterson investigation, including your claim that Mr. Peterson's investigation which lasted fewer than 50 hours according to my calculations, constitutes probable cause that you and Mr. Wade are guilty of the very same accusations for which the Atherton Police Department used its influence with the San Mateo County District Attorney to conduct a two-year long investigation upon me for upon identical grounds.
In support of this allegation I would call your attention to an inconsistency with statements you and your second in command have made to the press regarding the scope of my investigation.
To assist an independent investigator into my allegation that you and Lieutenant Wade have violated California Government Code Section 8314 I ask that you surrender all Town issued computers and communications devices in your possession. I ask that such devices be subject to a forensic examination (as were similar records and devices of mine during Atherton's personnel and criminal investigations upon me).
I also ask that all police department credit card receipts for calendar years 2006 and 2007 be obtained and reviewed by an investigator to ascertain whether there is indeed support for my assertion that on at least one occasion Lieutenant Wade was the beneficiary of an improper use of Town funds.
During our face to face meeting, I ask that Messrs. Buckheit, Carpernter and Riddle and Ms. Batti be allowed to attend as witnesses. I also ask that Mr. Danielson be requested to attend as well.
I ask that Mr. Peterson preserve and provide to an independent investigator all records of his investigation in response to my citizen's complaint and that of Mr. Buckheit's citizen's complaint. There are many questions which remain unanswered about Mr. Peterson's investigation. The most pressing issue is whether or not Mr. Peterson's conclusions can be supported by the evidence he assembled.
I for one believe that Mr. Peterson's findings, and your characterization thereof cannot be supported. I also believe that you have chosen to use the confidentiality of the process as a cloak to conceal what really went on during this investigation.
Please confirm your availability to meet with me this week as soon as possible so that I can arrange for my witnesses to be present as well. I am available any time on Tuesday, Wednesday or Thursday of this week and Wednesday through Friday of the following week.

As indicated in the attached my citizen's complaint, I cited a violation of California PC 424, evidence tampering, unlawful search and seizure and illegal detention. The latter two of these complaints I made it clear in correspondence with Mr. Peterson to constitute a deprivation of my civil rights under color of authority (a violation of Title 18 USC Section 242 and a crime with a 7 year statute of limitations).
However, your press release on the disposition of my citizen's complaint makes no reference whatsoever to these allegations.
Your e-mail to me also states that I complained about the conduct of two officers and then added two additional officers. This statement is also false.
As is documented in Mr. Peterson's e-mail to me, I registered a complaint against five officers:
Sherman Hall
Brad Mills
Kristin Nichols
Tim Marks
Tim Lynch
Additionally, since my earlier complaint included former Chief Robert Brennan, I complained about the conduct of six officere, not four.
It is for that reason I repeat my request, which officers did Mr. Peterson investigate, or more correctly which officers did you give Mr. Peterson permission to investigate?
By my count there are two officers who have yet to be investigated.
Finally, during my interview with Mr. Peterson he stated that he had once been accused of a crime. He did not state whether he was innocent nor did he indicate whether it occurred when he was in uniform at the time he was subject a criminal complaint. (Presumably the answer to both questions is yes). In any case, I do not believe Mr. Peterson should be considered independent or objective. He has made admissions as to his relationship with you and as to his background which clearly indicate that he has been compromised on both counts.
Please advise me as to when I will be apprised of just whom you investigated. Upon receipt of your reply it is my intention to file a new citizen's complaint to encompass those officers and crimes which have not heretofore been included within the scope of Mr. Peterson's investigation.
Finally, I did not receive any indication as to whether you will direct Mr. Peterson to comply with my request for a copy of the tape recording of my interview. Please advise as to when my request will be honored. As I said before, I recall agreeing to being tape recorded on the condition that I would receive a copy upon request. I am now making that request.

Mr. Johns,
I am in receipt of your e-mail requesting access to a confidential employee personnel investigation, which was initiated as a result of your Citizen's Complaint dated February 26, 2010 (copy attached). Your original complaint alleged that one employee unlawfully searched your office, and another employee falsified evidence. During the course of Mr. Peterson’s independent investigation, you asked for the investigation to be expanded to include two additional employees, which was done. Mr. Peterson completed an independent investigation, and determined that the allegations against each of the four involved employees were unfounded. The law does not allow you to have access to these files per Sections 832.7 and 832.8 of the California Penal Code without a court order. Atherton Police Department policy affords you the opportunity, or any citizen, to meet with me to discuss the findings of a Citizen Complaint. If you would like to meet with me about your complaint, we can schedule a meeting. Given your current claim against the Town, someone from the City Attorney's office will be in attendance at that meeting However, please keep in mind, that the law prevents me from discussing anything other than what is indicated in the above cited penal code sections.
