The Tornado Approaching Atherton Town Hall

Original post made by John P Johns, another community, on Jul 24, 2010

The Town of Atherton is about to meet its match. Atherton is about to find out that there is something worse than a woman scorned. What is worse than a woman scorned is a with money, brains and a reason to take on the Town.

I will not name that woman out of respect for her privacy. I have however spoken with her. During this conversation I felt like a surburban commuter who found himself behind the wheel a race car during the indy 500. I was overwhelmed. I suspect that the Town be as well when it finds itself in defense against allegations of gross neglegence by the Atherton Building Department.

During this telephone conversation I was thanked for my "pioneering" work in taking on the Town. During this conversation this woman expressed her gratitude to Jon Buckheit as well. She said that without the work Jon and of me, her task would be difficult if not impossible.

This woman was far too generous. This woman was also far too modest. After speaking with her I felt superfluous. I felt as though what I did and what Jon was doing, no matter how valuable or courageous, was inconsequential. I felt this way because I felt the full force of this woman's personality, her creativity, her sharp wit and her motivation.

After hanging up the telephone, I honestly felt sorry for anybody in the Town who gets in her way. I honestly felt that this tornado of woman with no help from anybody, not mine, not Jon Buckheit's will bring that corrupt power structure in Town down as though it were a house of cards in a stiff breeze.

A breath of fresh air is comming to town. Unfortunately for those corrupt, complacent, powerful few, the air will be quite turbulent.

The rest of us will most certainly enjoy the ride!

Does she plan to run for a seat on the council?

She is suing the Town. I believe her cause of action is the Building Department's gross negligence in performing inspections on her home while it was being built.

Jerry Carlson, by having me do an audit of the building department has helped her case a great deal.

There is a considerable amount of material in my report indicative of gross negligence, incompetence and collusion in the Building Department.

If the City Council's reaction had been something other than denial and defiance it coùld have reduced its exposure to this kind of litigation.

My pending claim against the Town of Atherton makes it impossible, for ethical reasons, for me to run for a seat on the council. It is my fervent hope that qualified members of our community will step forward in this time of crisis and serve their community, which so desperately needs competency and moral fiber. It is truly disturbing that with all our resources (in this community), both financial and educational, the Town of Atherton is not a role model for the entire country. Rather, it is, quite simply, an embarrassment and a disaster.

I took the time to attend the council meeting last week. I encouraged the council members to meet with Ms. Sweidy in a mediation to at least try to work out her issues in good faith. Instead, the majority opted for a path of stonewalling and litigation. I do not think this is wise, nor reflective of any learning taking place from previous mistakes that cost taxpayers hard earned money that didn't need to get spent. I share the same sense of disturbance that Ms. Sweidy does. This community needs desperately to be re-prioritized in favor of the residents who are paying the bills.

Kimberly Sweidy says "the Town of Atherton is not a role model for the entire country. Rather, it is, quite simply, an embarrassment and a disaster." This has been obvious from reading the newspaper over the past year.

When the people having problems need to become the people to fix the issues instead of benefitting from a government that protects them and solves their issues, that is the telltale sign. Mr. Buckheit has had to carry a lot of that water and now it appears he is being joined by Ms. Sweidy. This is a good sign for the Town of Atherton.
