What wonderful news! Considering the extreme bias reflected in Ms Furth's decisions affecting the town of Atherton, it is truly best that she be gone. Consider the recent case of the Lewis house nonconformities that she chose to say need not be pursued. Just the latest example of her incompetence. Perhaps the town can now hire someone whose opinion it can actually trust. This one's gotta go!

Wait! We still need Furth to exonerate Jerry Carlson on conflict of interest charges.

She better get her "legal analysis based upon stipulated facts" done soon.

Just because Ms. Furth's firm is gone, doesn't mean she will be. The council is still able to hire Ms. Furth as an individual... and I suspect they will likely do that.

There will be a new council in December.

The new council should decide on whether to hire a new city attorney, not Carlson, not Dobbie and not Marsala.

The most prudent thing would be for the current council to enter a new agreement with Ms. Furth, as an individual, to cover the seven month period between September 1, 2010 (the current termination date of Atherton's contract with Ms. Furth's firm) and March 31, 2011.

Extending Ms. Furth's agreement beyond this date would be unfair (and discourteous) to the new town council. This will provide the newly elected council members a full three months to identify and interview other candidates for this position. Ms. Furth can interview and submit a bid for services along with the other candidates.

This is precisely what other municipalities have done when facing a similar issue. There are several excellent private city attorneys in our area!
