Congratulations to Evelyn Chavez & Chris O'Dell , DA Evidence didn't match charges

Lopez, Chavez, O'Dell case.

All Charges against Evelyn Chavez and Chris were dropped today at the end of a 2 day Preliminary Hearing.
Hon. Judge Lisa Novak heard all the evidence presented by DDA Albanto and Inspector Jordan Boyd.

Some will remember the DA's Office through Scott Morris of Bay City News to 7 local newspapers said Evelyn and Juan embezzled up to $400,000 of his campaign funds. No such evidence ever appeared and almost every cent in that account was Juan Lopez's.

All Conspiracy charges are now gone after about 1.5 years in the system.

Juan Lopez does continue to face several charges his next court date is April 21, 2016

You can bet that Nobody from the DA's Office is going to say I'm Sorry to Evelyn or Chris.

I say Congratulations to both of you and you attorneys, and I'm sorry for the way my DA treated you.

Yay!! Good news for Evelyn Chavez and Chris O'Dell. Hope they speak up about the flagrant and shocking abuse of power by the San Mateo DA's office. I know that this has all been very, very hard on Chavez and Lopez.

It would be great if San Mateo County could just get 3 Supervisors to realize that they are responsible for the bad behavior of our District Attorneys Office. This is nothing new and ordinary citizens have been reporting this very subject for many years.

The fact the DA lost a preliminary hearing is very telling. They "never" lose preliminary hearings. The level of proof required is a joke. It's a slam dunk to get past a prelim.

This is all about retribution against Deputy Lopez.

The really big issue here is the Sheriff Greg Munks and D.A. Steve Wagstaffe are "going after" Juan Lopez in a very unusual and horrible way, because Lopez ran against Munks in an election, which is supposed to be one of the most protected things an American citizen can do. D.A. Wagstaffe even had Lopez's GIRLFRIEND criminally arrested and charged over what turned out to be absolutely NOTHING. As Menlo Voter pointed out, if there's even a flimsy, minuscule amount of evidence at a preliminary hearing, the defendant has to stand trial. The defendant gets out on the preliminary hearing maybe 1 in 10,000 times at best. This is what happened here and it's just about unheard of. It is equivalent to a legal finding of innocence.

We all know this is not how Wagstaffe usually operates. Right now he is treating another sheriff's deputy, Deputy Mar, with kid gloves. According to multiple witnesses, this deputy pulled out his gun, aimed it at a janitor IN THE COURTROOM HE WAS PAID TO MAINTAIN ORDER IN, and threatened "South Carolina Justice"! But this deputy was not arrested. He was charged with a minor misdemeanor (and probably only then because the newspapers had reported on it) and his girlfriend/wife certainly was not arrested also.

Does it disturb people who read this that the sheriff and D.A. are going after a police officer because this officer, Juan Lopez, ran in an election against his boss, the sheriff, and lost? I really hope so, because it disturbs me. This is not what America is supposed to be about. What I was taught at least is that whether we agree or disagree with someone, they have the right to state their opinions, vote, run in an election, and participate in the democratic process without being retaliated against. That's North Korea.

By the way, Karen Guidotti is neck deep in this as well. She works right under Wagstaffe and hopes to succeed him as D.A. That would be horrible, as any person with a conscience would not participate in garbage like this.

During SMC DA Inspector Jordan Boyd's testimony He talked about August 4, 2014, He told us about how he got Sheriff Deputy Juan P. Lopez to surrender his cell phone and give up his password. He testified that he did not give miranda rights.

I kept waiting for him to testify about demanding Juan P. Lopez to surrender his California Drivers License. I was curious how he knew in advance that it was suspended 7 months prior. I wanted him to explain why he and others followed Deputy Lopez to his vehicle to make sure he didn't drive that day. The DA never brought this subject up.
I have filed a criminal complaint with SMC DA and Attorney General Office for the crime of Hacking the State of California DMV Computer System in this case. Somebody accessed the data base and put Deputy Lopez's number on another persons ticket. He was without a license for 3 months.

Another point was made that the County Counsel came over to Jordan Boyd's office and delivered doc's that he used for one of the criminal counts, No Search Warrant, or request made, just being helpful, it was from his Civil Service Appeal.

Speaking of Search Warrants and Prosecutorial Misconduct, on the fist day Inspector Jordan Boyd and Mr.Albanto mentioned a Search Warrant produced by SMC DA Inspector Draper. ALL three Defense Attorneys looked at each other with that shocked look the Judge saw that and asked them if they had received it in Discovery supplied by the DA's Office,……..NO was the answer from all three. This was the first time they had heard of it. After hours of delay for the DA to prove he had supplied the information about the Draper Search Warrant the judge ordered that nothing about it may be discussed.

Attorney Stuart Hanlon got DA Inspector Jordan Boyd to identify Senior Inspector William Massey as his boss.
He was asked if he knew William Massey contacted Evelyn Chavez's boss, trying to get her fired. Also William Massey contacted Jerry Walker when he saw he supported Deputy Juan Lopez for Sheriff, "What are you doing."

That is a lot more involvement than we would expect from our DA's Office.

Another Defense attorney got DA Inspector Jordan Boyd to acknowledge that he not only knows about the cell phone software by Harris Corporation called Stingray & Hailstorm but that it would be available to him if he requested it.
That is Huge.

Questions:

1) What were the exact charges against Ms. Chavez that were dropped?

2) Did prosecutor Bryan Abanto put up a fight? Did he voice objections to Judge's ruling? Did he seem upset?

3) Were there any reporters at the hearing?

4) Will the Almanac be covering this?

5) Has the Palo Alto Daily Post done anything on this?

I was the only person in the courtroom for the full 2 day hearing. a couple of people came and went but no paper represented.

Many of us would like to know what was said by the prosecutor in the courtroom as regards to the outcome, and most definitely a comment from District Attorney Wagstaffe and what his rationale was for bringing the charges to begin with. This is a job for the Almanac.

She wasn't running for office.

Clarification time, The above were all the charges some applied to Evelyn and Chris.

Evelyn Segura Chavez was charged with Count 1 and Count 10

ChrisOdell was charged with Count 1 and Count 3

San Mateo County District Attorney Inspector Jordan Boyd testified 3/29/2016 in the PH of Lopez, Chavez & Odell that he is familiar with the Software named StringRay and he has access to it.

That is going to make the Juan P. Lopez trial very exciting.

Sting Ray is one of the Harris Corporations products. It tricks cell phones, mimics cell towers etc.
