Sequoia Healthcare District cancels Regular Meeting, AGAIN!

Directors Shefren and Faro got together again to request cancelling(a.k.a. rescheduling) one of the 6 REGULAR meetings annually scheduled by the District. The August 5, 2015 meeting has been "rescheduled" to August 26th. History will show that these same two Directors were responsible for the "rescheduling" of the August 7, 2013 REGULAR meeting.

Never mind that the three remaining Directors would have provided a quorum to conduct both of those meetings on the regularly scheduled date.

By the rescheduling of these meetings, these two Directors avoid having their names recorded as being absent from a REGULAR meeting. This could be somewhat embarrassing, particularly for Director Faro(now President of the Board) whose absence at the last REGULAR meeting precipitated a situation in which a quorum was not available for all action items. A similar situation occurred at the April 1, meeting when Director Kane's absence led to lack of a quorum for a Samaritan House grant.

I take full credit for denying a quorum in those situations above where district policy would have allowed approval of those items with only 2 yes votes. That's LESS than a majority for our 5 member board. I informed the board that such a policy was unsustainable. I was rewarded with censure by the board.Web Link

I have tried to get our board to change director compensation from an outrageous subsidy of health insurance premiums to a stipend(~$100) for meeting attendance, which is what Peninsula Healthcare District does. Instead, the board raised the subsidy from $14,400/year to $16,200/year. That's $2,700/meeting!

At our August 6, 2014 meeting, Director Faro was telecommuting from his Oregon Ranch, sitting on his porch watching deer in the field while having a glass of wine. (meeting audio available on request) Mr. Faro rejected my proposed amendment to a motion he had made, which would have eliminated the $14,400/year health insurance benefit which directors receive, and replace it with a stipend for meeting attendance as is done by Peninsula Healthcare District. I fear for civilization.

Thank heavens I did not have to reschedule anything in the last two years.

Terry Francke of CalAware provided this info on the subject:

"Jack, you or anyone else has the right to see the communications from directors announcing their unavailability for the regular meeting. In the words of the Public Records Act, the nature of the conflict would not be an "unwarranted" invasion of personal privacy. You do not need a "specific law" making this information public, since, as the lawyer well understands, the burden runs the other way. The information is presumed public unless a "specific law" makes it confidential. These people are taking time off in a way that disrupts the plans and schedules of an unknown number of people. Had they given sufficient advance notice it might have been possible to stagger their absences to avoid disrupting their official schedule. The least they can do is explain why their personal plans take precedence over their public duties."

Since Shefren and Faro have not responded to requests for such explanation, I offer this as a plausible scenario:

Shefren: Art, I won't be able to attend the August 5 meeting.

Faro: Gee, Jerry, that puts us in an awkward position. With only 4 Directors, and Katie recusing herself again when the St. Vincent de Paul grant comes up, Hickey is sure to walk out again to deny us a quorum.

Shefren: Why don't we reschedule the meeting. How about August 26?

Faro: That works for me.

The public deserves an explanation.

At this rate, golly, the next meeting they will need to reschedule is the August, 2017 meeting. Mark it on your calendar now, Jack!

While creating an attendance chart, I discovered that Director Faro only physically attended 2 out of the last 6 REGULARLY scheduled Board meetings.(he did attend one other meeting by teleconference from his ranch in Oregon)
No wonder he doesn't want the August meeting to be held on it's regular date.

That's one year's of meetings for which Faro was reimbursed more than $15,000 in health insurance reimbursement. Nice job if you can get it.

Anyone care to run for a seat so you can help me shut down this obsolete district?

How many times in the last decade have you missed a meeting or walked out to deny a quorum?

Or use any other parliamentary procedure to block or otherwise limit voting on a grant?

Special Interest Groups have kept these 2 Directors elected time after time.
Why do the voters allow this to continue?
This Special District has outlived its mission.
It's time to allow the voters a chance to stop the double dip system.
Special Interest Groups ask for grants from the Board of Supervisors and the Sequoia Healthcare District, that's double dipping.

"The Sequoia Healthcare District has a 5 member Board, for which a quorum is 3. It has a policy which allows only 2 directors to pass a measure when a quorum of 3 are present. I am committed to not allow such a vote to take place. By vacating my seat at the table when such situations arise, I have disallowed such votes to be taken by denying them a quorum."

I regret to say that there have been only 3 instances in which I refused to allow 2 directors of our 5 member board to approve a grant of taxpayer's money by denying them a quorum. The first time I was presented with that opportunity, I failed to take advantage of the situation. For that I am sorry.

3 times you have prevented a quorum, purely to use a parliamentary move as a delaying tactic.

And yet you trumpet loudly and self-righteously about a meeting being rescheduled, the first such rescheduling in 20+ meetings.

You don't see this, do you? Take off the goggles, Mr. Hickey. You give politicians a bad name.

I invite readers with an interest in resolving the issue of Hospital Districts which have morphed into Healthcare Districts to visit Web Link and engage in the dialogue.

I will continue to pursue the purpose for which I was elected.

And, those of you who value the presence of Sequoia Hospital which voters facilitated by creating the Hospital District in 1946 can thank me for my referendum petitioning effort, in 2003, which led to upgrading of that hospital on it's historic site.

A Politician that represents Special Interest Groups gives a bad name to the word politician.
Mr. Jack Hickey represents the taxpayer, not the Special Interest Groups, he wants the voters to decide to the future of the Sequoia Healthcare District.
The Special Interest Groups are a great voting block, but if more taxpayers get out and vote the Special Interest Groups would not be able to control the current Sequoia Healthcare District.

Sequoia Healthcare District President, Art Faro, who also Chairs the Sequoia Hospital Board of Directors, should consider relinquishing his seat on the SHD Board. Director Kane also sits on the Sequoia Hospital Board of Directors. She should consider doing the same. They could then focus their philanthropic efforts on the Sequoia Hospital Community Benefit Implementation Plan. Web Link

Their conflicted votes on Hospital related grants have been reported in this venue. There is still time to have a District election consolidated with the November election so that we could elect replacements.
