claim now made that work product, which was supposed to be kept for 3 years, was discarded by McIntyre and Malcolm Smith in the interview, is not offering to produce this work (at this time?) either.

Mayor Mueller says he's going to hire yet another consultant - an outside investigator -with no legal authority to subpoena the missing documents. Just another waste of taxpayer dollars. Please just hire a new City manager already. This isn't the first time McIntyre has mislead the public and the council. No City investigation is going to turn up the documents that have been destroyed. While the article states that the consultant is required to hold onto the work product, there are also City rules concerning the destruction of work product that apply. McIntyre has admitted to destroying the evidence. That is reason enough to replace him with out anymore theater. Just do it and let's move on.

A factual, informative article with no suggestion that anything the City communicated to voters broke the law by expressly advocating a no or yes vote on Measure M.

Lots of stupidity but no illegality.

Agree that this could be a case of mere stupidity, based on the incomplete evidence before us, but is Malcolm Smith flirting with breach of contract if he cannot (or simply refuses) to produce all of his work and communications with city staff for this project, given the clear contractual three-year requirement to do so?

Come on, when Peter Carpenter admits that the city manager behaved stupidly, if not illegal then isn't it time to replace him with a higher caliber city manager? This isn't the first time McIntyre has been an embarrassment.

I would prefer to believe a couple of duly educated and practicing law, real lawyers, who say there is definite "illegality" involved here.

Also, why in the world did it take two months to disclose this material (just 4 days before the election!), when a public records act requrest is supposed to be completed in 10 days?

Carpenter, a self anointed icon claiming he is for "good and transparent government" sure doesn't act that way, does he?

Anyone believing that, in today's world, one simply hand writes such work product, and that no computer copies remain, I find simply without any sense of reality.

We need to see this work product, which was not to be destroyed, by contract terms, for at least 3 years.

You confuse my dedication to transparency with your dedication to vigilantism.

I like to have the facts before looking for the hanging tree.


But then you are just 'looking on' with no accountability, no responsibility and evidently no sense of the law.

Amazing that anyone would defend the City manager given that we all seem to agree that he acted with ''lots of stupidity.'
The illegality is still up for debate and he will face the legal consequences of his actions. So why in the world would anyone, including our City Council not demand his resignation? McIntyre doesn't have to break the law to get his walking papers, just do some really stupid things. This one takes the cake.

I would assume based on your anonymity that you ALSO have made mistakes and wish to hide the fact.

I am not one to quote the bible but Morris and the rest of you: John 8:7 - And as they continued to ask him, he stood up and said to them, “Let him who is without sin among you be the first to throw a stone at her.”

Dudes, ease up. I was part of the exhaustive search for what I consider to be an excellent City Manager. We don't know everything.

And @Morris Brown, NONE of this is going to change the fact that Measure M lost because it was HORRIBLE legislation. Your re posting of articles from EVERY newspaper in the peninsula is NOT a good substitute for an original thought....

Thanks for trying, but your exhaustive search did not turn up the best for our city. Now it's time to start the search all over again, and with a better search committee.
