Decision on charges near against Kelly Fergusson

A criminal investigation into whether Menlo Park Councilwoman Kelly Fergusson broke the law in her attempt to become mayor is expected to end this week - and District Attorney Steve Wagstaffe could review the report as early as Thursday.

An investigation by City Attorney Bill McClure uncovered that Fergusson, on separate occasions, told Rich Cline and Peter Ohtaki that she wanted to be mayor.

Investigators from the district attorney's office gathered documents and interviewed everyone involved.

My bet is that DA Wagstaffe does nothing and refuses to prosecute.

As I told the DA: "if you turn your back on this proven and admitted violation then you are clearly signaling to all the other public officials in San Mateo County that they can ignore the Brown Act during your tenure as our District Attorney without fear of sanction or punishment."

The sad thing is that the DA just doesn't seem to care if people violate ethics laws. There seems to be a hole in his soul.

Now the censor at the Almanac has taken to deleting posts without even noting they were deleted.

I noted that City Attorney McClure had done a terrible job on the whole affair and deserved to be heavily criticized by the DA at the very least.

One can only hope but somehow I doubt that the DA will be heavily criticizing City Attorney Mcclure.

The election as mayor has been overturned. That's plenty in my book. The Council and our community and the DA have far more important work to do than beat this up any more. The cure has occurred.

Not enough - the council nullified the election and elected new officers as was required by my 'cure and correct' letter. The council has not authority and took no action regarding Fergusson's illegal serial meeting - that is a criminal matter (like speeding, driving without a license etc) and that responsibility rests with the DA. If the DA turn hus back on this proven and admitted violation then he is clearly signaling to all the other public officials in San Mateo County that they can ignore the Brown Act during his tenure as our District Attorney without fear of sanction or punishment."

Government in secrecy is not government of the people, by the people and for the people.

enough is enough -

By your logic, we should excuse bank robbers if they just return the money. After all, no harm, no foul.

It's ironic that so many other posts on this website preach that we must all play by the rules... like when some homeowner wants to cut down a redwood tree. I guess the rules apply to everyone but Ms. Fergusson.

The Daily Post today 1/28, now says the DA has the report and is reviewing it and will make a decision early next week.

Not only should Fergusson be on the hook, what about McClure and his incompetent handling of the situation? [Portion removed; unfounded speculation about someone's criminal behavior violates terms of use.]

In any case, MP looks terrible and other Cities have picked up and commented on the "back door" politics going on around here.

Facebook is coming to Menlo Park, whether we want them or not. Palo Alto was smart and is shoving them out. Another cast off from Palo Alto to Menlo Park.

Yes, there aren't enough empty buildings in MP yet. Why take in a new, rich firm that can employ THOUSANDS of people?

And indeed this is just what Menlo Park needs; thousands of new workers here, swelling the already over laoded schools, highways and city streets.

A company growing this large will do wonders for our quality of life, which should be the number one priority of our City staff and Council.

Palo Alto didn't want them, so the same reasons Menlo Park should not want them.

Yes, old timer, we could run a helluva hotel if not for the guests.

Those pesky businesses that employ people who pay taxes and fund your medicare and social security benefits can be a real inconvenience when they have to get to work, can't they?
