So, the judge found flaws in their EIS/EIR, but won’t require them to stop or change the project level work going on now. I suppose that the importance of the earmarked stimulus funds to a nearly bankrupt state is more important that the frivolities of fixing the environmental impact statement. After all, they manipulate the findings and results of their alternatives studies to make them come out the way they intent anyhow. At this point, they can fix the program-level 'errors' with project-level solutions. But, let's capture all the federal dollars we can in this money-starved state, regardless of the purpose.
My first introduction to EIR documents stunned me. I thought I was reading marketing brochures rather than expected independent, critical analyses. If the program-level analysis was found flawed, we can rest assured that the project-level EIS will be likewise the bending and twisting of reality to make their justifications for their decisions appear legitimate.
My suggestions for those who still cherish hopes of having the lawsuit reconsidered, or of appealing it, or whatever, with the dream of obtaining a decision reversal from Pacheco to Altamont, give it up. Let’s move on.
This isn’t a game. Our communities and their possible destruction are at stake here. We have more than enough to complain and possibly sue about. It’s an ill-conceived project, promoted by people I wouldn’t buy a used car from. Despite all their “outreach” rhetoric, they really don’t care about us or their impact on the communities through which the rail corridor passes. We need to pull up our socks, tighten our belts and get to work to protect our neighborhoods and cities from this home-wrecker project.
